# Accessibility Overlays: Do They Make a Website Accessible?

Accessibility overlays are scripts or widgets that promise to make a website accessible or compliant automatically, often for a monthly fee. This guide explains what they do, what regulators and disability organisations have said about them, and what works instead.

## Short answer
No. An accessibility overlay adds a toolbar or script on top of a website but does not fix the underlying code that assistive technologies rely on, so it cannot make a site fully WCAG, ADA or EAA compliant. The European Disability Forum says overlays do not ensure compliance, and the US FTC acted against an overlay vendor's compliance claims.

## Key facts

- **What an overlay is:** A third-party script or widget added to a site, often with a toolbar of display options
- **Can it guarantee WCAG compliance?:** No; the barriers are in the site's code and content
- **FTC action:** January 2025: an overlay vendor ordered to pay $1 million over claims its AI tool could make any website WCAG compliant
- **European Disability Forum:** 17 May 2023 joint statement with IAAP: overlays do not make websites compliant with European accessibility legislation
- **Possible harm:** Can interfere with users' assistive technology and override their settings (EDF/IAAP)
- **What works:** Fixing the source code and content, verified with automated and manual testing

## What is an accessibility overlay?

An overlay is a script a site owner adds with one line of code. It usually shows a floating accessibility button that opens a toolbar with options such as larger text, contrast modes or a reading guide, and some products also try to repair code automatically, for example by guessing alt text or adding ARIA attributes after the page loads.

Overlays are often marketed as a fast, cheap route to WCAG, ADA or European compliance. The problem is that the barriers disabled people face are in the site's own markup, content and behaviour, and a layer added on top cannot reliably fix them.

## Why can't an overlay make a website compliant?

Many WCAG requirements need human judgment about meaning and behaviour, which software applied after the fact cannot supply:

- Alt text must describe what an image means in context; an automatic guess is often wrong or unhelpful.
- Form labels, error messages and instructions must be accurate for each field and task.
- Keyboard access depends on how custom controls were built; a script cannot always make them operable in a sensible order.
- Headings and structure must reflect the content's real organisation.
- Video needs accurate captions and audio description, written or checked by people.
- Display options in a toolbar duplicate settings disabled people already have in their browsers and devices.

## What have regulators and disability organisations said?

In January 2025 the US Federal Trade Commission announced an order requiring the overlay vendor accessiBe to pay $1 million to settle allegations that it misrepresented the ability of its AI-powered tool to make any website compliant with WCAG. The FTC said overstating a product's AI or other capabilities without adequate evidence is deceptive.

In May 2023 the European Disability Forum and the International Association of Accessibility Professionals issued a joint statement that overlays do not make a website accessible or compliant with European accessibility legislation, are not a substitute for fixing the website itself, and can interfere with users' assistive technology. The Overlay Fact Sheet, signed by a large number of accessibility practitioners, says full compliance cannot be achieved with an overlay.

## What should you do instead of using an overlay?

Put the budget into fixing the site:

- Scan your key templates to find the code-level failures; AccessibilityScore.in does this for free for a single page.
- Fix issues in the source code and CMS templates so the fix applies everywhere.
- Test important tasks with a keyboard and a screen reader.
- Train content editors to write alt text, headings, link text and accessible documents.
- Publish an honest accessibility statement with a way to report problems.
- Commission a manual audit before making compliance claims.

## Accessibility overlay vs fixing the source code

| Aspect | Overlay or widget | Source-code remediation |
| --- | --- | --- |
| What changes | A layer added on top after the page loads | The site's own code and content |
| Fixes meaning, such as alt text and labels | Guesses automatically | Written and checked by people |
| Works with users' assistive technology | Can interfere with it (EDF/IAAP) | Built to work with it |
| Supports a compliance claim | No | Yes, when verified by testing |
| Cost over time | Ongoing subscription | Up-front work, then upkeep |

## Common questions

### Do accessibility overlays work?
They can change how a page looks, but they do not fix the underlying code and content, so they cannot make a site fully accessible or compliant with WCAG.

### Will an overlay protect me from an ADA lawsuit?
An overlay does not remove the barriers that lead to complaints, so it does not make a site ADA compliant. Fixing the barriers in the source is the reliable approach. This is not legal advice.

### Are overlays allowed under the European Accessibility Act?
Using one is not forbidden, but the European Disability Forum and IAAP say overlays do not make websites compliant with European accessibility legislation. Compliance depends on the site itself.

### What did the FTC decide about accessiBe?
In January 2025 the FTC announced an order requiring accessiBe to pay $1 million over allegations that it misrepresented its tool's ability to make any website WCAG compliant.

### Do disabled users like accessibility overlays?
Disability organisations such as the European Disability Forum have warned that overlays can interfere with assistive technology and override user settings that people already rely on.

### Is an automated scanner the same as an overlay?
No. A scanner such as AccessibilityScore.in finds problems for you to fix in your code; it does not change your site or claim to make it compliant.
